OFFICIAL RULES AND REGULATIONS

THIS PROMOTION IS INTENDED FOR THE UNITED STATES AND IS SUBJECT TO U.S. LAW. DO NOT ENTER IF YOU ARE NOT LOCATED WITHIN THE UNITED STATES. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. PARTICIPATION CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.

PROMOTION PERIOD: DISH Outdoors Giveaway (the "Promotion") begins on April 4th, 2023 at 9:00:00 a.m. Central Standard Time ("CST") and ends on April 30th, 2023 at 11:59:59 p.m. CST (the "Promotion Period").

SPONSOR: Pace International, "DBA: DISHForMyRV", 3582 Technology Dr. NW, Rochester, MN 55901

ELIGIBILITY: Promotion is open only to legal residents of the United States (excluding Florida) and the District of Columbia, who are at least 18 years of age or older at time of entry. Officers, directors, shareholders and employees of Pace International (“Sponsor”) and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotional agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Promotion (collectively, the "Released Parties"), and their immediate family members (spouse, parents, step-parents, children, step-children, siblings and their respective spouses, regardless of where they reside) and those living in the same household of each such individual, whether or not related, are not eligible to enter or win a prize. Void where prohibited or restricted by law. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Regulations, and Sponsor and administrator's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

ENTRY DETAILS: Eligible participants may enter the Promotion by completing the entry form before the end of the Promotion Period via the contest page (Explore DISH Outdoors) and following the instructions that appear to complete the entry form. Once you have completed the required fields, you will receive a confirmation email. Completed entries will allow for additional ways to add entries to increase odds of winning. Each additional method rewards additional entries to the qualified entrant and are subject to approval. One eligible entry per email address.  Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods. Entrants violating any of these Official Rules and Regulations may be disqualified. By entering an email address and completing additional questions, entrant will automatically be eligible and entered. Eligible participants may also enter the Promotion by mailing in a self-addressed envelope containing the entrant’s name, address, phone number and email if preferred. Mail to DISHForRV Promotions at 3582 Technology Drive NW, Rochester, MN 55901. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate. Sponsor's database clock will be the official timekeeping device for the Promotion. One entry per person will be used in the randomized drawing pool. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned.

PRIZES/APPROXIMATE RETAIL VALUE: One (1) Winner will be chosen for the grand prize pack including a Playmaker Antenna Bundle with an approximate prize value of the package is $418.00.

RANDOM DRAWING: Administrator is an independent judging organization whose decisions as to the administration and operation of the Promotion and the selection of the potential winners are final and binding in all matters related to the Promotion. Administrator will randomly select one (1) potential winner for each prize pack from all eligible entries received per day as planned and published.  Odds of winning depend on the number of entries received.  The potential winner will be notified via the contact email they provided during entry on or about 12 hours after the random drawing, by Sponsor or its designated representatives, whose decisions are final. Upon notification, potential winner must accept the Prize as directed by Sponsor within 24 hours of notification. Winner announcement will be made to the general public once the winner responds to Sponsor and accepts the prize. Any potential winner notification not responded to or returned as undeliverable may result in Prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by Sponsor. If a potential winner of any prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information within the required time period (if applicable), or the Prize is returned as undeliverable, the potential winner forfeits the Prize. Receiving a prize is contingent upon compliance with these Official Rules and Regulations. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries in the original entry pool. Only three (3) alternate drawings will be held, after which the Prize will remain un-awarded. Prizes will be fulfilled approximately four (4) weeks after the conclusion of the Promotion.

CONDITION OF PRIZE: Sponsor and Released Parties have not made any warranty, representation or guarantee, expressed or implied, in fact or in law, with respect to any prize awarded and specifically disclaim all such warranties, including, without limitation, any warranty of merchantability or fitness for a particular purpose. The Prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND either expressed or implied. The Prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in Sponsor's sole discretion. Sponsor reserves the right to substitute the Prize (or prize component) for one of equal or greater value if the designated Prize (or prize component) should become unavailable for any reason. Sponsor and Released Parties are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Contest.

The prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive. The stated "ARV" of the prizes is based on available information provided to Sponsor, and any difference in ARV at the time of awarding will not be awarded, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. A prize winner may be required to provide Sponsor with a valid social security number (should the ARV of the respective prize be equal or greater than $600, social security number will be required) and complete a W-9 form before a prize will be awarded for tax reporting purposes. An IRS Form 1099-MISC may be issued in the name of the respective prize winner for the total ARV of the prize, as stated above, in the calendar year the prize was won. All properly claimed prizes will be awarded.

The winner’s acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation.

GENERAL: Sponsor reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. By participating, participants agree to abide and be bound by these Official Rules and Regulations and the decisions of Sponsor, which are final and binding in all matters. Entrants who have not complied with these Official Rules and Regulations are subject to disqualification. Sponsor reserves the right, at its sole discretion, to disqualify any entrant from this Promotion or any other promotion conducted now or in the future by Sponsor or any of its affiliates if Sponsor suspects or finds entrant to be: (1) violating the Official Rules and Regulations; (2) tampering or attempting to tamper with the entry process or the operation of the Promotion; (3) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or (4) attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deceiving, participating in any other unfair practices, or intending to annoy, abuse, threaten or harass any other entrants, the Sponsor, or Sponsor’s representatives.

ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE THE PROMOTION WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE PROMOTION.

RELEASE: Sponsor and the Released Parties do not assume any responsibility and the entrant releases the Sponsor and the Released Parties from any and all liability, claims, losses, actions, damages, and demands of any kind, whether known or unknown, including death or injury to persons or property, arising out of, or relating to, participation in the Promotion, and the acceptance, use, misuse or possession of any prize.

LIMITATIONS OF LIABILITY: Sponsor and the Released Parties are not responsible for (1) the incorrect or inaccurate capture of entry information; (2) technical failures of any kind, including, but not limited to, late, lost, undeliverable, damaged, misdirected, stolen, garbled or incomplete entries, transmissions or transactions, those that are altered or otherwise irregular, or do not conform with or satisfy any or all of the conditions of the Official Rules and Regulations; (3) unauthorized human intervention in any part of the entry process of the Promotion; (4) any technical or human error which may occur in the administration of the Promotion or during the processing of entries; (5) the security or privacy of information transmitted via computer networks; (6) any loss, injury, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt, use, or misuse of any prize; or (7) electronic communications which are undeliverable for any reason. Entry material/data that has been tampered with or altered shall be void.

DISPUTES:  Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred NOT TO EXCEED ONE HUNDRED DOLLARS ($100), including costs associated with entering this Promotion, but in no event shall it include attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

PUBLICITY: Except where prohibited, participation in the Promotion constitutes consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown (“Personal Information”) for promotional purposes in any media, worldwide, without further payment or consideration or notification of permission. All Personal Information submitted as part of the Promotion may be shared by and between the Sponsor and the Released Parties, and each will use such information in accordance with their respective independent online privacy policies. Personal Information is not sold to any other parties. By entering your email address, you hereby expressly consent to receive emails from DISHForMyRV regarding DISH Mobile products and services.

WINNERS LIST: For Promotion results and/or a copy of these Official Rules and Regulations, send a self-addressed, stamped, business size (#10) envelope to: DISHForMYRV's "RVing in the USA Giveaway",  3582 Technology Dr. NW, Rochester, MN 55901.  Requests must be received by April 30th, 2023.

GOVERNING LAW: All disputes concerning the construction, interpretation, validity, effect, and enforceability of these Official Rules and Regulations, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the State of Minnesota without giving effect to any choice of law or conflict of law provisions (whether of the State of Minnesota or any other jurisdiction) or other provisions that might cause the application of any other states’ laws. Entrant agrees that exclusive jurisdiction over any legal action arising out of or in connection with the Promotion will be in state or federal courts located in or nearest to Olmsted County, Minnesota, and by entering consents to such jurisdiction and venue.
